Welcome to NameSpark! These Terms of Service ("Terms") govern your use of the NameSpark mobile application ("App") provided by Hangzhou RefineTech Co., Ltd. ("Company", "we", "us", or "our"). By downloading, installing, or using our App, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using NameSpark, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, please do not use the App.

2. Description of Service

NameSpark is a baby name discovery application that helps users explore, discover, and save baby names. The App provides:

• A curated collection of baby names with meanings, origins, and cultural backgrounds
• Name browsing through an interactive card-swiping interface (swipe right to like, left to skip)
• Ability to save and organize favorite names in your personal collection
• Name pronunciation features with text-to-speech support
• Detailed name information including meaning, origin, gender, and popularity
• Name exploration by categories and styles (Classic, Modern, Unique, etc.)
• Family sharing capabilities through invite codes for collaborative name selection
• Premium subscription features for enhanced functionality

3. User Accounts

When you use NameSpark, we automatically create a user profile associated with your device. You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account.

4. Subscription and Payments

NameSpark offers weekly and yearly Premium subscriptions that provide additional functionality beyond the free version of the App.

4.1 Premium Subscriptions

Both weekly and yearly Premium subscriptions include the following benefits:

• Unlimited Name Access: Browse and discover unlimited baby names without daily restrictions
• All Name Categories: Access to all name styles and categories (Classic, Modern, Unique, Traditional, Trendy, etc.)
• Advanced Search & Filters: Filter names by origin, meaning, length, and popularity
• Unlimited Saves: Save unlimited names to your favorites collection
• Priority Support: Get faster responses from our customer support team
• Ad-Free Experience: Enjoy the app without any advertisements

4.2 Subscription Pricing

• Weekly Premium: $2.99 USD per week (or equivalent in local currency)
• Yearly Premium: $19.99 USD per year (or equivalent in local currency)
• Prices may vary by region and are subject to change. The actual price will be displayed in the App before purchase.

4.3 Subscription Terms

• Payment will be charged to your Apple App Store or Google Play account at confirmation of purchase
• Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current billing period
• Your account will be charged for renewal within 24 hours prior to the end of the current period at the same price
• You can manage and cancel your subscription at any time by going to your account settings in the App Store (iOS) or Google Play Store (Android)
• Cancellation will take effect at the end of the current billing period; you will retain access to premium features until then

4.4 Restore Purchases

If you have previously purchased a subscription, you can restore your purchase by tapping "Restore Purchases" in the subscription screen. This is useful if you reinstall the app or switch to a new device.

4.5 Refund Policy

• All purchases are final and non-refundable, except as required by applicable law
• Refund requests must be submitted through Apple App Store or Google Play Store directly
• We do not provide refunds for partial subscription periods
• If you believe you were charged in error, please contact our support team

5. User Conduct

You agree not to:

• Use the App for any unlawful purpose
• Attempt to gain unauthorized access to the App or its systems
• Interfere with or disrupt the App's functionality
• Copy, modify, or distribute the App's content without authorization
• Use automated systems or software to extract data from the App

6. Intellectual Property

All content, features, and functionality of NameSpark, including but not limited to text, graphics, logos, icons, images, and software, are the exclusive property of Hangzhou RefineTech Co., Ltd. and are protected by international copyright, trademark, and other intellectual property laws.

7. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components.

8. Limitation of Liability

To the maximum extent permitted by law, Hangzhou RefineTech Co., Ltd. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the App.

9. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of any material changes by updating the "Last Updated" date at the top of these Terms. Your continued use of the App after such modifications constitutes your acceptance of the updated Terms.

10. Termination

We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the App will immediately cease.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the People's Republic of China, without regard to its conflict of law provisions.
